THIS IS AN ACT FORMULATED BY GOVERNMENT OF N.C.T OF DELHI

The objective of the Act is to regulate the working and employment conditions of worker employed in shops and establishments including commercial establishments. The Act generally provides for fixation of working hours, rest intervals, overtime, holidays, leave, termination of service, maintenance of shops and establishments and other rights and obligations of the employers and employees.

The Act also provides for registration for shops and establishments. However, the requirement of registration has been kept in abeyance since 1989.


One of the Assistant Labour Commissioners of the Labour Department has been appointed as Chief Inspector of Shops and Establishments to carry out the enforcement and other functions prescribed under the Act. Inspections are carried out to ensure the opening and closing hours of shops and establishments fixed under the Act. Challans are filed against the defaulting employers by the Chief Inspector Inspector of shops on the report of the area Inspector before the area Metropolitan Magistrate.

The penalty provided for contravention of any provision of the Act and rules made thereunder is fine which shall not be less than Rs.25/- and which may extend to Rs.250/-. However if a person is convicted for willfully making false entries in any record, register or notice, he shall be liable for imprisonment for a term not exceeding three months.The said penalty is imposed by MM.
